Tenancy Deposit Failures by Landlords
Many landlords fail to meet their legal obligations when handling tenancy deposits. In some cases, they don’t provide tenants with the required documents or fail to confirm that deposits have been protected in a government-approved scheme.
Tenants renting from buy-to-let landlords often face unfair deductions, long delays, or complete refusal when trying to recover their deposits.
“We never thought we’d get anything back.”
— a common experience among tenants who discover their deposits were never properly protected.
How Do Landlords Fail to Protect Tenancy Deposits?
Landlords may fail to comply with tenancy deposit protection rules in several ways, including:
-
Not protecting the deposit within 30 days of receiving it in one of the three government-backed schemes.
-
Failing to provide “prescribed information” — confirming where and how the deposit has been protected.
-
Withholding or mismanaging deposits, leading to disputes and financial loss for tenants.
If your landlord has failed in any of these duties, you may be entitled to claim compensation of up to three times your original deposit.

Research suggests that over 500,000 renters in the UK may currently have unprotected deposits — with around 14.5% of all tenancy deposits not properly safeguarded by landlords.
If you paid a deposit to your landlord or letting agent and it wasn’t protected, you could be entitled to compensation.
Was Your Tenancy Deposit Protected?
If any of the following situations apply to you, it’s possible your tenancy deposit was not protected in line with the law:
-
Deposit protected late – Even if your deposit was eventually protected, it must be done within 30 days of payment.
-
Unfair deposit deductions – If deductions seem unreasonable, this may indicate the deposit wasn’t properly protected.
-
Deposit not returned – If your landlord refuses to return your deposit or delays payment, you may have a valid claim.
-
Stayed longer than agreed – Your deposit must remain protected throughout your entire tenancy, even if your stay is extended.
-
No deposit information provided – Landlords must give you written confirmation from the deposit protection scheme used. If you never received this, your deposit may not be protected.
Make a Tenancy Deposit Compensation Claim

Landlords Still Failing to Protect Tenancy Deposits
The Centre for Economics and Business Research (CEBR) estimates that 14.5% of all tenancy deposits in the UK are not protected by landlords or letting agents.
In its latest report on deposit protection compliance, the CEBR found that:
-
Around 1.1 million tenancy deposits are unaccounted for, and
-
More than 500,000 cash deposits may currently be unprotected,
putting an estimated £578 million at risk in the hands of landlords and agents who have failed to comply with tenancy deposit laws.
