Phoenix Legal Secures £2,000 Compensation in Housing Disrepair Claim

Our Landlord and Tenant Team Secures £2,000 Compensation for Tenant in Housing Disrepair Claim

Our Landlord and Tenant team at Phoenix Legal has successfully recovered £2,000 in compensation for a tenant following a housing disrepair claim against a social housing provider.

Long-Standing Damp and Mould Problems

Our client had been living with persistent damp and mould for a prolonged period. Although both the tenant and the landlord carried out repeated mould washes, the problem continued to return, making it clear that the underlying cause had not been addressed.

Despite the tenant raising ongoing concerns, the landlord failed to properly investigate whether a more significant defect within the property was responsible for the recurring damp and mould. As a result, our client was left living in unsuitable conditions for far longer than they should have been.

Identifying the Root Cause

After being instructed, our team acted swiftly. We sent a Letter of Claim to the landlord and arranged for an independent surveyor to inspect the property.

The survey identified the underlying cause of the damp and mould, providing the evidence needed to demonstrate that the issue extended far beyond surface-level mould growth.

Repairs Completed and Compensation Secured

Following receipt of the evidence, the landlord agreed to carry out all of the necessary repair works. The repairs were completed, significantly improving our client’s living conditions and ensuring that the underlying defects were properly addressed.

With the repairs resolved, our focus turned to recovering compensation for the distress, inconvenience and loss of amenity our client had experienced, together with the legal costs of the claim. Following negotiations, a fair and reasonable settlement was reached, with our client receiving £2,000 in compensation.

Housing Disrepair Claims

No tenant should have to live in a property affected by persistent damp and mould because a landlord has failed to investigate and remedy the underlying cause. This case highlights the importance of seeking expert legal advice where repair issues remain unresolved despite repeated complaints.

If your landlord has failed to carry out necessary repairs, or you are experiencing ongoing issues with damp, mould or other defects in your home, Phoenix Legal’s experienced Landlord and Tenant team may be able to help you secure the repairs you are entitled to and recover compensation for the impact the disrepair has had on your daily life.
