When Landlords Fail to Carry Out Repairs

Landlords have a legal responsibility to keep rented homes safe and in good repair. Unfortunately, many tenants are left living with problems that affect their health, damage their belongings and make everyday life difficult.

Common issues include damp and mould, leaks, structural problems, faulty heating, electrical hazards and pest infestations.

“I kept reporting the problems, but nothing changed.”

Many tenants feel they have no choice but to live with poor conditions. In reality, if your landlord has failed to act after being told about the problem, you may have the right to make a claim.

What Problems Can You Claim For?

Housing disrepair claims can include issues such as:

    • Damp and mould
    • Plumbing leaks and blocked drains
    • Structural damage
    • No heating or hot water
    • Electrical hazards
    • Pest infestations

These are some of the most common repair issues, but many other types of disrepair may also qualify.

Could You Have a Housing Disrepair Claim?

You may be able to claim if:

    • You reported the repair issue to your landlord.
    • Your landlord failed to carry out the repairs within a reasonable time.
    • The disrepair has affected your home, belongings or quality of life.
    • You are a council, housing association or private tenant.

If these apply to you, you may be entitled to repairs and compensation.

    What Could You Claim?

If your landlord has failed to deal with serious disrepair, you may be able to claim for:

    • Repairs to your home.
    • Compensation for living in poor conditions.
    • Damage to personal belongings caused by the disrepair.
    • Additional compensation if the disrepair has affected your health.

The amount you could receive depends on factors including:

    • How serious the disrepair is.
    • How long the problem has existed.
    • The impact it has had on your daily life.

Do Landlords Have to Carry Out Repairs?

Landlords are responsible for keeping their rental properties safe and fit to live in.

      This includes maintaining:

      • The structure of the property.
      • Heating and hot water.
      • Plumbing and drainage.
      • Electrical installations.
      • Certain pest problems where they affect health and safety.

If your landlord has failed to carry out these repairs after being notified, you may be entitled to make a housing disrepair claim.

How Long Do You Have to Make a Claim?

In most cases, you have up to six years to make a housing disrepair claim.

If the disrepair has caused illness or injury, different time limits may apply.

If you’re unsure whether you’re still within the time limit, our team can assess your situation.

Could You Have More Than One Claim?

If your landlord has failed to carry out repairs, it’s worth checking whether they’ve also met their other legal obligations. Some landlords who fail to deal with housing disrepair also fail to protect tenancy deposits correctly or obtain the correct HMO licence where one is required.

If more than one of these issues affects your tenancy, you could be entitled to pursue more than one claim.
